Safeguarding Policy
JakTrack processes sensitive information about children. This policy explains what we do if we encounter information suggesting a child may be at risk.
Our Role
We are not a safeguarding agency. JakTrack is a tracking and evidence-building tool for families navigating the SEND system. We do not monitor content, we do not investigate concerns, and we are not a substitute for professional safeguarding advice.
When safeguarding concerns come to our attention through normal operation of the service, we refer them to the appropriate statutory agencies. We do not attempt to assess or resolve them ourselves.
What We Consider a Safeguarding Concern
A safeguarding concern arises when information suggests a child may be suffering or at risk of significant harm - including physical abuse, emotional abuse, sexual abuse, neglect, exploitation, or self-harm.
Most content on JakTrack describes the challenging realities of SEND parenting. Difficult behaviours, meltdowns, sleep deprivation, and parental stress are normal parts of this experience and are not treated as safeguarding concerns.
How We Respond
If concerning content comes to our attention:
- Record - We note what was seen, when, and where. We do not investigate.
- Assess urgency - Immediate risk to life: 999. Serious concern: local authority children's services (MASH) within 24 hours. Uncertain: NSPCC helpline (0808 800 5000) for advice.
- Refer - We share relevant information with the appropriate statutory agency.
- Record the outcome - All safeguarding actions are documented and retained.
Legal Basis
UK data protection law supports information sharing for safeguarding purposes. The ICO states:
“It will never breach UK data protection law to share all the information you need to with an appropriate person or authority in order to safeguard a child.”
Our lawful basis for disclosure:
- UK GDPR Article 6(1)(f) - Legitimate interests (protecting a child from harm)
- DPA 2018 Schedule 1, Condition 18 - Safeguarding of children and individuals at risk
Consent from the parent or carer is not required to make a safeguarding referral. In some cases, seeking consent could increase the risk to the child.
Police and Court Requests
We cooperate with lawful data requests from police, courts, and statutory agencies. All requests are verified before data is disclosed. We log every request and what was provided.
Parents may use JakTrack data as evidence in family court proceedings. This is a legitimate use of the service.
