Terms of Service

Welcome to JakTrack. By using our service, you agree to these terms. Please read them carefully.

1. About JakTrack

JakTrack is operated by ContextEngine Ltd, registered in England and Wales (company number: 16536241).

JakTrack is a web application that helps UK families caring for children with special educational needs and disabilities (SEND):

  • Track daily observations, sleep patterns, and meals
  • Build and maintain detailed child profiles through AI-assisted onboarding
  • Analyse EHCP (Education, Health and Care Plan) documents and generate amendment letters
  • Assess benefits eligibility and build supporting evidence
  • Track SEND processes (EHCP applications, DLA claims, SALT referrals)
  • Detect milestones and regressions from your tracking data
  • Generate professional handoff packs for appointments

2. Who Can Use JakTrack

To use JakTrack, you must:

  • Be at least 18 years old
  • Be a carer (parent, grandparent, foster carer, kinship carer, or legal guardian) of the child(ren) whose data you enter, with appropriate legal authority
  • Have the legal authority to consent to data processing on behalf of your child(ren)
  • Provide accurate information when creating your account

3. Your Account

You are responsible for:

  • Keeping your password secure and confidential
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorised access

We may suspend or terminate accounts that violate these terms.

4. Subscription and Payment

Free Trial

JakTrack offers a 14-day free trial with full access to all features. During your trial:

  • You provide payment details at sign-up, but your card is not charged during the trial period
  • You can cancel at any time during the trial without being charged
  • If you do not cancel before the trial ends, your paid subscription begins automatically

We will send you a reminder email before your trial ends.

Pricing

After your free trial, JakTrack is a paid subscription service. Current pricing is displayed on our website and during the sign-up process. Pricing may vary based on promotional offers.

Billing

  • Subscriptions are billed monthly or annually via Stripe
  • Your first payment is taken when your free trial ends
  • You can cancel at any time from your account settings
  • Cancellation takes effect at the end of your current billing period — you retain access until then

Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a subscription contract within 14 days of the contract being entered into.

Because JakTrack includes a 14-day free trial with no charge, you can exercise this right simply by cancelling before your trial ends. No payment will have been taken.

If your paid subscription has already begun and you wish to cancel within your first billing period, contact us at [email protected] and we will provide a pro-rata refund for unused whole months.

Price Changes

We may change our prices with 30 days' notice. Existing subscribers will be notified by email before any price change affects them. If you do not agree with a price change, you may cancel before it takes effect.

5. What You Can Do

You may use JakTrack to:

  • Record observations about children in your care
  • Upload and analyse EHCP documents
  • Generate evidence packs and handoff summaries for official purposes
  • Share child profiles with other family members or professionals you authorise
  • Export your data at any time

6. What You Cannot Do

You must not:

  • Enter information about children you do not have legal authority to care for
  • Share your account credentials with others
  • Use the service for any illegal purpose
  • Attempt to access other users' data
  • Impersonate professionals (e.g., claim credentials you don't have)
  • Upload malicious files or attempt to compromise our systems
  • Use automated systems to access the service (bots, scrapers)
  • Attempt to manipulate or circumvent AI safety measures

7. Important Disclaimers

Not Medical or Legal Advice

JakTrack is a tracking and documentation tool, not a medical or legal service. The information, reports, AI-generated suggestions, EHCP analysis, and amendment letter drafts provided by JakTrack are for informational purposes only. They do not constitute medical advice, diagnoses, or legal counsel.

Always consult qualified professionals:

  • For medical concerns, consult your GP, paediatrician, or relevant specialists
  • For legal matters (including EHCP appeals), consult a solicitor or SEND specialist
  • For educational advice, work with your child's school and local authority

Benefits Eligibility Estimates

JakTrack provides estimates of potential eligibility for benefits such as Disability Living Allowance (DLA), Carer's Allowance, and Blue Badge. These are estimates only, not guarantees. Actual eligibility is determined solely by the relevant government body (DWP, local authority). Monetary figures shown are based on published rates and your child's profile data - actual awards may differ. You should not rely solely on JakTrack's estimates when making financial decisions or applications.

EHCP Analysis & Amendment Letters

JakTrack can analyse EHCP documents and generate draft amendment letters with references to the SEND Code of Practice. These drafts are starting points for discussion, not legal documents. They have not been reviewed by a solicitor and may not reflect the specific legal nuances of your case. We strongly recommend having any amendment letters reviewed by a SEND solicitor or specialist adviser before submitting them to your local authority.

AI-Generated Content

JakTrack uses AI to help analyse diary entries, detect patterns, check EHCP language, draft letters, and suggest profile updates. AI-generated content may be:

  • Inaccurate or incomplete
  • Missing important context
  • Not suitable for your specific situation

Always review AI suggestions carefully before accepting or using them. Milestone and regression detection, evidence strength scores, and pattern analysis are based on the data you provide and may produce false positives or miss important changes. You remain responsible for the accuracy of your child's profile and any documents you submit based on AI-generated drafts.

Data Accuracy

You are responsible for the accuracy of the information you enter into JakTrack. AI-powered features (profile suggestions, milestone detection, evidence scoring) are derived from the data you provide - if the underlying data is incomplete or inaccurate, the outputs will reflect that. We recommend reviewing your child's profile periodically and before using any JakTrack outputs in official applications, meetings, or tribunal proceedings.

8. Beta Features & Service Changes

JakTrack is under active development. From time to time we may:

  • Introduce new features in beta or early access - these may be incomplete, change significantly, or be removed
  • Modify or discontinue existing features with reasonable notice
  • Change data formats or structures (we will migrate your data where possible)

Beta features are provided "as is" and may not be as reliable as established features. We will clearly label features that are in beta.

9. Service Availability

We aim to keep JakTrack available 24/7, but we cannot guarantee uninterrupted access. We may:

  • Perform scheduled maintenance (we'll try to notify you in advance)
  • Experience unexpected downtime due to technical issues
  • Temporarily suspend service to address security concerns

We are not liable for any losses resulting from service unavailability.

Data Loss

While we take reasonable precautions to protect your data (including regular backups and encryption), no system is infallible. We cannot guarantee against data loss due to technical failures, security incidents, or events beyond our control. We strongly recommend using the export feature periodically to keep your own copy of important data, particularly before EHCP reviews, tribunal hearings, or benefits applications.

10. Your Content

You retain ownership of all content you create in JakTrack (diary entries, profiles, uploaded files, EHCP documents). By using the service, you grant us a licence to:

  • Store and display your content to you
  • Process your content with AI to provide features
  • Share your content as you direct (e.g., with family members you invite)

We will never use your content for advertising or sell it to third parties.

11. Intellectual Property

JakTrack, including its design, code, and features, is owned by ContextEngine Ltd. You may not copy, modify, or redistribute the service or its components.

12. Third-Party Services

JakTrack relies on third-party services to operate. These services have their own terms and privacy policies:

We are not responsible for the availability, accuracy, or conduct of third-party services. If a third-party service experiences an outage or changes its terms, we will do our best to minimise disruption but cannot guarantee unaffected service.

13. Limitation of Liability

To the maximum extent permitted by UK law:

  • JakTrack is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for decisions made based on JakTrack's outputs, including benefits eligibility estimates, EHCP analysis, detection results, or AI-generated content
  • We are not liable for the outcome of any benefits application, EHCP process, tribunal, or meeting where JakTrack data or outputs are used
  • Our total liability to you shall not exceed the amount you paid us in the past 12 months

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold harmless ContextEngine Ltd, its directors, employees, and agents from any claims, losses, or damages (including legal fees) arising from:

  • Your use of JakTrack in violation of these terms
  • Data you enter about children you do not have legal authority to care for
  • Your representation of AI-generated content as professional medical or legal advice
  • Submitting JakTrack outputs (amendment letters, evidence packs, handoff packs) without appropriate professional review

15. Safeguarding

JakTrack processes sensitive information about children, including health data, behavioural observations, and daily care records. We take our responsibility seriously.

If content on the platform suggests a child may be at risk of significant harm, ContextEngine Ltd reserves the right to share relevant information with appropriate statutory agencies (including police, children's social care, and the NSPCC) without prior notice to the account holder.

This is permitted under UK data protection law (DPA 2018 Schedule 1, Condition 18 — safeguarding of children and individuals at risk) and does not require consent.

We are not a safeguarding agency. We do not monitor content for safeguarding purposes, we do not investigate concerns, and we are not a substitute for professional advice. When concerns come to our attention, we refer them to statutory agencies — we do not attempt to assess or resolve them ourselves.

16. Changes to These Terms

We may update these terms from time to time. For significant changes:

  • We will notify you by email at least 30 days before changes take effect
  • Continued use after the effective date means you accept the new terms
  • If you disagree with changes, you may close your account before they take effect

Minor clarifications or corrections (typos, formatting, updated links) may be made without advance notice.

17. Termination

You may close your account at any time from Settings → Privacy & Data → Delete Account. We recommend exporting your data before closing your account.

We may terminate or suspend your account if you:

  • Violate these terms
  • Engage in fraudulent activity
  • Harm other users or the service

Upon termination, your data will be retained for 30 days then permanently deleted (see our Privacy Policy). If you cancel during your free trial, no payment will be taken. If you cancel during a paid billing period, you retain access until the end of that period.

18. Force Majeure

We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications failures, power outages, cyberattacks, or failures of third-party services we rely on.

19. Governing Law & Disputes

These terms are governed by the laws of England and Wales.

If you have a dispute with us, please contact us first at [email protected] so we can try to resolve it informally. If we cannot reach a resolution within 30 days, either party may pursue formal proceedings in the courts of England and Wales.

20. General Provisions

  • Entire agreement - These terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ContextEngine Ltd regarding your use of JakTrack.
  • Severability - If any provision of these terms is found to be unenforceable or invalid by a court, the remaining provisions shall continue in full force and effect.
  • No waiver - Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision.
  • Assignment - You may not assign or transfer your account or these terms without our written consent. We may assign our rights and obligations under these terms in connection with a merger, acquisition, or sale of assets.
